End User License Agreement
The licence under which you may install and use BuggyGames software.
This EULA is between you and Bugfinder Marek Misiak, trading as BuggyGames. It covers Toxiqa TD, Toxic Grid, Vigor Habits and IF & Autophagy Timer, together with their Apple Watch and Garmin companions.
Apple’s standard Licensed Application End User License Agreement does not apply to our apps; this document replaces it.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the software on devices you own or control, as permitted by the rules of the store you obtained it from, and for your own non-commercial use.
We license the software to you. We do not sell it. We keep all rights not expressly granted here.
Restrictions
You may not copy the software except as needed for normal use and backup; rent, lease, lend, sell, redistribute or sublicense it; reverse-engineer, decompile or disassemble it, or attempt to derive its source code, except to the extent the law expressly permits regardless of this restriction; or remove any proprietary notices.
Ownership and third-party material
The software, its artwork, audio and text are owned by us or licensed to us, and are protected by copyright.
The games are built with the Godot Engine, used under the MIT licence. Toxiqa TD includes the sound effect Spark 1 by ERH, obtained from Freesound under the Creative Commons Attribution 4.0 licence. Full third-party notices ship inside each product.
Data
Using the software is subject to our Privacy Policy and to the policy for the individual product.
Apple-specific terms
For apps obtained from the App Store, these additional terms apply and Apple is a third-party beneficiary of this EULA, entitled to enforce it against you:
- This agreement is between you and us only, not with Apple. Apple is not responsible for the software or its content.
- Apple has no obligation to provide maintenance or support for the software.
- If the software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the software.
- We, not Apple, are responsible for addressing any claim that the software or your use of it infringes intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
Termination
This licence ends automatically if you breach it. On termination you must stop using the software and delete all copies. Uninstalling a product ends the licence at any time.
Warranty and liability
To the extent permitted by law the software is provided “as is”. This does not affect your statutory rights as a consumer, and does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Governing law
Polish law governs this agreement, without prejudice to the mandatory consumer protections of your own country of residence.
